It looks like Trulieve Cannabis Corp. (CSE: TRUL) (OTCQX: TCNNF) is ready for round two.

The recreational marijuana campaign that Trulieve bankrolled last year – and which fell just short at the ballot box of the 60% it needed to become law – has returned, and on Tuesday it formally filed a new cannabis legalization measure it intends to get on the 2026 statewide ballot, The News Service of Florida reported.

The new initiative filed by Smart & Safe Florida – the political action committee which ran the campaign – is significantly different from the failed 2024 version, which lost despite garnering 56% of the vote, given Florida’s supermajority requirement for amendments to the state constitution. The tweaks appear to be designed to appease opponents such as Gov. Ron DeSantis, USA Today reported.

“When enough signatures are gathered to put this measure on the 2026 ballot, and upon Supreme Court approval, Floridians will have the opportunity to vote for adults over the age of 21 to have the ability to access the same freedom enjoyed by over half the country in consuming safe, lab-tested cannabis products in their own homes,” Smart & Safe told USA Today.

The new updated initiative is different from the 2024 version in that it would:

  • Ban marijuana smoking in public.
  • Prohibit marketing aimed at children.
  • Allow for private companies that are not vertically integrated.
  • Let the legislature decide whether home grows should be allowed.

Most of the rest of the initiative remains the same as the 2024 measure, and it appears likely that Trulieve is ready to again spend enormous sums to get it passed.

The multistate operator donated roughly $144 million of the $152 million that Smart & Safe raised during the election cycle, The News Service of Florida noted. And Trulieve has arguably the most to win from legalization, given its footprint of 160 dispensaries in the state, the most of any licensed marijuana business in Florida. No other operator has more than 79 shops, according to a Jan. 10 report from the Florida Office of Medical Marijuana Use.
