Norwegian Activists Challenge ECtHR’s Silence on Cannabis Prohibition

For over 15 years, the European Court of Human Rights (ECtHR) has sidestepped a critical human rights question: Are criminal penalties for cannabis possession proportionate under the European Convention on Human Rights (ECHR)? On June 23 and 24, 2025, Norwegian activists from the Alliance for Rights-Oriented Drug Policies (AROD) will stage bold civil disobedience in Strasbourg to demand accountability from the ECtHR and the Parliamentary Assembly of the Council of Europe (PACE).

AROD’s Requiem for the Rule of Law exhibition will expose the Court’s failure to scrutinize cannabis prohibition, a policy increasingly at odds with evidence from regulated markets in Germany, Malta, and Luxembourg. These countries have shown that legalization reduces harm and protects public health, yet the ECtHR dismisses challenges to prohibition as “manifestly ill-founded” without reasoning. This opacity, AROD argues, violates procedural fairness and undermines the ECHR’s principles.

On June 23 and 24, from 10:00 AM to 2:00 PM, activists will protest outside PACE’s Palais de l’Europe during its Summer Session, urging parliamentarians to address the Court’s inaction. On June 24, from 3:00 PM to 6:00 PM, a powerful exhibition at Place de la Cathédrale will confront the ECtHR directly, using vivid imagery to highlight systemic failures.

AROD’s actions raise a broader alarm: when courts evade novel legal issues, they risk perpetuating arbitrary persecution. As the Council of Europe’s own bodies, including PACE and the Pompidou Group, question the Court’s deference to prohibition, the call for reform grows urgent.
