NJ CANNABIS UPDATE
Introduced on Monday, Senate Bill S4779 would overhaul New Jersey cannabis regulation and enforcement. Among other aspects, as written S4779:
✳️ Restructures New Jersey’s cannabis oversight by abolishing the independent Cannabis Regulatory Commission (CRC), currently housed “in but not of” the Department of the Treasury, and transferring all of its functions, powers, and duties to a newly created Division of State Cannabis Oversight, Regulation, and Enforcement (SCORE) within the Department of Law and Public Safety.
✳️ Terminates CRC members’ terms and transitions its staff to SCORE, including by installing the current CRC Chair as the inaugural Director of SCORE until a successor is appointed by the Governor with Senate consent and installing the current CRC Executive Director as a Deputy Director of SCORE.
✳️ Requires the Director of SCORE to report directly to the Attorney General.
✳️ Increases state enforcement capabilities by (1) shifting all regulatory and enforcement responsibilities shift to SCORE, (2) providing SCORE explicit authority to take action against unlicensed cannabis operations to bolster related municipal efforts, and (3) expanding the Alcoholic Beverage Control Enforcement Bureau and renaming it the Bureau of Alcohol and Cannabis Enforcement (BACE) and granting its investigators full police powers – including arrest and firearm authority – regarding cannabis violations (current CRC investigators may transfer to BACE or remain in other roles within SCORE).
✳️ Maintains non-intoxicating hemp (≤0.3% delta-9 THC dry-weight) as exempt from cannabis laws, but classifies intoxicating hemp products (≥0.5 mg total THC per serving or ≥2.5 mg per package) as “cannabis items,” with related regulation, licensing and enforcement by SCORE and BACE.
✳️ Updates numerous statutes to replace references to the CRC with SCORE, revises provisions to reflect BACE’s expanded jurisdiction, and removes obsolete language – such as transitional rules from the 2019 transfer of the medical cannabis program from the Department of Health and interim measures that expired once personal-use licensing began.
✳️ Provides that all existing licenses, permits, regulations, and orders remain in effect until modified or superseded by SCORE.
