Newsom said that he was taking steps to close loopholes, and to increase enforcement in order to prevent children from gaining access to these dangerous hemp and marijuana products.

- Setting a minimum purchase age of 21 for certain hemp products.
- No detectable THC allowed in hemp-derived foods and beverages.
- Limiting hemp products per package to five servings.
- Expanding the list Cannabinoids are regulated as intoxicating cannabinoids.
The list of cannabinoids regulated does not include CBD, a non-intoxicating substance found in hemp. The CDPH’s findings indicate that even compounds that are not harmful to adults can be harmful to youth. State officials claim that the age requirement is a protective measure because the list of cannabinoids that are intoxicating is not exhaustive, and research is ongoing on the effects on youth.

Once the regulations become effective, state agencies, such as the Department of Cannabis Control (DCC) and the Department of Alcoholic Beverage Control (DBAC), will begin to enforce the regulations.
Nicole Elliott, Director of Department of Cannabis Control called the rules a “critical step in ensuring that the products on the market align with the original intent of the law.”
The regulations are intended to close loopholes that existed in AB 45 signed by Newsom in 2020, which allowed hemp products but limited the total THC content at 0.3%. Officials claim some manufacturers have violated the law. This limit has been circumvented, leading products to have intoxicating effects.
Industry Impact
Although specific economic projections are not provided, The CDPH determined The regulations would have a “significant economic impact on California businesses and individuals.”
In a press release issued by the Governor’s Office, Joseph McCullough said that the Department of Alcoholic Beverage Control will contact licensees, stakeholder groups, and other interested parties to ensure compliance after the regulations come into effect.
The hemp industry has grown rapidly since the 2018 federal Farm Bill allowed industrial hemp. California’s decision could influence other states that are grappling with similar concerns regarding hemp-derived products. Other states have also fought over hemp-derived products. FloridaMost recently, Missouri.
Health officials cite research showing that these products can negatively affect cognitive functions in developing brains. There are reports of increased hospitalizations for teenagers and young adult.
The regulations also Standardize serving sizes For hemp products, use federal standards for food products that are not made from hemp as a guide.
Enforcement and testing
Compliance will be monitored by state regulators, including CDPH and law enforcers. The regulations require manufacturers to provide documentation, such as certificates of analysis from independent laboratories, in order to confirm that their products meet the THC limits.
Nick Maduros is the Director of the California Department of Tax and Fee Administration. He said that “our cannabis and tobacco inspectors” are on the ground every day to ensure that consumers know that the products in stores are legal, properly tested, labelled, and taxed.
According to CDPH findings, the emergency regulations are necessary “to preserve the immediate peace, health, or safety of the public, or the general welfare.”
