California Gov. Gavin Newsom proposed emergency regulations last week to completely ban the sales of any hemp-derived THC product in the state. The proposed rules would also establish the minimum age for purchasing hemp products at 21.

California Gov. Gavin Newsom (D) on Friday proposed Emergency Regulations Golden State is attempting to ban the sale of hemp-derived THC products.

The California Department of Public Health’s (CDPH) new regulations would require that all hemp-derived products sold within the state have “no detectable amounts of total THC”, including delta-8 THC and delta-10 THC and more than two dozen other analogs. They would also create a limit of five servings per package of hemp-derived products. Consumable hemp products would also be restricted to adults 21 years of age or older.

Officials from the state say that the regulation will prevent children from being exposed in the state to unregulated and potentially harmful intoxicating hemp products.

We will not sit by and watch as drug dealers target our children in our retail stores with dangerous hemp products containing THC that are unregulated. We’re taking steps to close loopholes, increase enforcement and prevent children from gaining access to these dangerous hemp and marijuana products.” — Governor. Newsom, in an Press release

The rules would then take effect immediately after being approved by the Office of Administrative Law. The Hill reports. The rules, if implemented, would essentially wipeout the California Hemp product industry: Almost every industry offering is affected by the ban on THC content and serving proportions.

The Hemp Roundtable was told Benzinga“Today’s emergency action” by Governor Newsom, is a betrayal to California hemp farmers, small business owners, and adult consumers. Newsom’s Administration failed to enforce AB 45 after having supported it.

Meanwhile, SF Gate Reports state that the California Cannabis Industry Trade Group praised the proposed regulations. They said the action would “create safer, more transparent markets” and ensure that harmful, unregulated products will no longer undermine the strict cannabis laws of our state.
