Austria: Only tobacconists allowed to sell CBD flowers – hemp shops take legal action

2025-07-22 | Since January 2025, only tobacconists (Trafiken) in Austria are allowed to sell dried hemp flowers with less than 0.3% THC, according to Der Standard. As such, they fall under the tobacco monopoly, as ruled by the Austrian Administrative Court. While tobacconists are still slowly entering the new market – with many stores still lacking products – established CBD shops are under pressure. They face inspections, fines, and product seizures by customs and the Ministry of Finance.

The Austrian Cannabis Industry Association (ÖCB) reports over 90 inspections and plans to appeal to the Constitutional Court. Around 500 specialty shops with over 1,000 employees are at risk. The association cites a 2015 ruling that declared the tobacco monopoly on e-cigarettes unconstitutional – and hopes for a similar outcome regarding CBD flowers. While some advocate for a “regulated system” with strict controls, hemp shops emphasize their self-regulation and demand fair market conditions. A meeting with the Ministry of Finance is scheduled for the end of August.
