When work resumes in February, the Senate Agriculture and Agrarian Reform Committee (CRA) may vote on a series of projects, which are already ready for the agenda. One of them is the BILL 5,511/2023, which regulates the medicinal use of cannabis-derived products.

Authored by Senator Mara Gabrilli (PSD-SP), the proposal creates a legal framework for the sector: the text provides for regulations on the cultivation, production, import and trade of cannabis and its derivatives for medicinal, human and veterinary purposes.

Furthermore, the draft determines that the production of cannabis and its derivatives will depend on prior authorization from the competent federal authority.

According to the text, authorization may be granted to individuals who make medicinal use of the substance, their legal guardians (in the case of incapacitated individuals), non-profit patient support associations and producers who meet the required legal requirements.

The initiative received a favourable report two years after its submission and is ready for a vote in the CRA.

The rapporteur for the matter is Senator Professora Dorinha Seabra (União-TO), who supports its approval with some changes. She pointed out that the text defines clear technical parameters on: THC limits (tetrahydrocannabinol, the main psychoactive component of cannabis), licensing requirements, traceability and good agricultural practices.

Control mechanisms

To include changes and additions to the project, Dorinha recommends its approval in the form of a substitute.

She argues that the central pillar of her substitute is security and that its objective was “ensure that production authorized by this [future] law is not diverted to the illicit market.” To this end, the rapporteur explains that included in the proposal “detailed and rigorous” control mechanisms.

One such mechanism is the cultivation quota, which links production “to legitimate demand and with a medical prescription”. Another mechanism included by it is the security plan, which must contain requirements for georeferencing, video monitoring and strict access control.

Agroindustry

Dorinha also states that the project goes beyond the humanitarian dimension and represents a new frontier for the country’s agricultural and agro-industrial development.

She notes that cannabis is related to a short-cycle crop, suitable for crop rotation and with multiple applications — such as textile fibers, cellulose, building materials, food, feed, and non-psychoactive medicinal and veterinary inputs.

The rapporteur highlights that countries such as Canada, the United States, China and members of the European Union already invest in this market, recognizing its economic and environmental potential.

She believes that, in the Brazilian case, favorable climate conditions and the expertise of national agricultural research can guarantee competitiveness, “as long as there is legal certainty for planting and processing.”

— We are talking about a concrete opportunity for productive diversification, with income generation in the countryside, technological innovation and respect for legal and health limits — declared Dorinha during a meeting at CRA.

  • PL 977/2025, by Senator Mecias de Jesus (Republicanos-RR), who establishes specific rules for the search and seizure of agricultural machinery;
  • BILL 1,348/2024, by then senator Janaína Farias (CE), who encourages the use of bioinputs in agriculture;
  • BILL 1,851/2024, by Senator Sérgio Petecão (PSD-AC), deals with environmental licensing for small and medium-sized aquaculture enterprises;
  • PL 3,591/2019, by Senator Luis Carlos Heinze (PP-RS), reduces the rate of Financial Compensation for Mineral Exploration (CFEM) levied on limestone for agricultural use;
  • PL 4,206/2023, by Senator Paulo Paim (PT-RS), who encourages the creation of suspended community gardens in schools and social assistance units;
  • PL 3,784/2024, by then senator Bene Camacho (MA), which characterizes the provision of environmental services as a rural activity for the purposes of calculating Income Tax.
