The attorney for Noah Settles, known as No Savage, argued smoking marijuana is an essential part of rap culture.

A popular D.C. rapper who served time for opening fire inside the Tysons Corner Center mall in Northern Virginia will remain free after he was found guilty of violating his probation.

The attorney for Noah Settles, known as No Savage, argued in court Friday that one of Settles’ violations, smoking marijuana, is an essential part of rap culture.

The judge addressed the contention and took a different view.

“Mr. Settles, you have two choices: You can either stop using marijuana or you can stop rapping,” he said.

Settles pleaded guilty last year and served time for firing a gun inside the mall on Father’s Day weekend 2022, as caught on surveillance video. His gunshots were directed at a group of rivals. He missed his target and shoppers ran for their lives.

On Friday, the judge found him guilty of violating his probation but stopped short of sending him back to jail.

In a hearing last month, Settles’ attorney made an unusual request, asking the judge to consider lifting the requirement that Settles not smoke marijuana.

In an interview with News4 last month, Settles defended his marijuana use as legal.

“The judge rules is what it is, but, I mean, at the end of the day, it’s legal everywhere. I don’t do no other drugs,” he said.

Settles stopped going to the required substance abuse treatment and failed multiple drug screenings, according to court proceedings.

His lawyer updated the judge, said Settles had a new substance abuse evaluation and said he was resuming substance abuse treatment.

The lawyer asked that Settles’ probation charge be dismissed. The judge found him guilty but allowed him to remain free. Settles was ordered to avoid marijuana and continue substance abuse treatment and drug screenings.

The lawyer told News4 they have no comment.

If Settles violates the terms of his probation again, years of suspended jail time could be imposed.
