NLG: Federal Council votes against the intoxication clause

Last Friday, a majority of the Federal Council voted against the intoxication clause. This represents a stage success on the road to abolition. The BvCW had contacted all state agriculture ministers about this last week. Prior to this, several Bundesrat committees had recommended retaining it. A motion by Bavaria to reject the entire Utilized Hemp Liberalization Act (NLG) was rejected by a large majority. The Bundestag could therefore now pass the law if a majority can be found.

The Bundesrat also dealt with cannabis-related issues that do not concern industrial hemp. The committees’ recommendations for neutral packaging of cannabis seeds, regulation of cuttings and the enactment of missing regulations as well as the recommendation to simplify the notification requirements for industrial hemp growers also received a majority. The introduction of a background check for prevention officers was rejected. The BvCW rejects the introduction of neutral packaging for the commercial sale of cannabis products, as this makes it more difficult to create and differentiate product brands, facilitates counterfeiting, restricts consumer sovereignty and has little effect. The BvCW is also critical of the Federal Council’s decision to reduce the quantities sold in cultivation associations.  Overall, however, the decision is viewed positively.
