Around 275 workers would no longer be covered under the UFCW if the GTI employees won the decertification elections.

Employees of Green Thumb Industries (OTC: GTBIF), filed a petition to hold an election in order to remove the “monopoly “representation” of local 360 United Food and Commercial Workers union officials over them.

According to a National Right to Work statement, Michael Potter is a lead warehouse technologist for Green ThumbThe petition for decertification was filed by him on behalf of five coworkers in New Jersey.

Around 275 workers would be released from the UFCW’s bargaining power if GTI employees won the decertification elections.

Potter stated that “many of us feel the UFCW doesn’t advance our interests, and we would be better without the union at our workplace.” “We are simply seeking a secret ballot vote that was denied us when the union installed, so we can find out what the majority of Green Thumb’s employees want.”

Pressure to unionize

Potter claimed that he had collected more than enough signatures from employees on his petition in order to trigger a vote of decertification under NLRB regulations. He filed the petition to challenge so-called “card-check” unionization campaigns, which he claims UFCW bosses used against his coworkers.

The statement stated that union officials could bypass the secret ballot process with card checks as long as there is a majority of employees who want to unionize. Employees claimed that without a secret ballot “union officials could repeatedly ask and pressure workers face to face to sign union authorization cards which were then counted to impose the Union on workers.”

New Jersey also lacks a Right to Work Law, so union officials are able to demand that workers pay union fees or dues just to remain employed. Employees who did not want to join a union or oppose one are also subject to its contract decisions.

Days to spare

Potter filed his petition as there were still days left under a 2020 reform of the NLRB election rules. The “Election Protection Rule” allows employees to submit petitions for decertification to force a secret vote after a union gains control through a card-check.

The NLRB in Washington, D.C., however, issued a final ruling that went into effect on Sept. 30, which undoes Election Protection Rule, and makes it harder for workers who oppose union officials to vote them out.

Mark Mix, President of the National Right to Work Foundation, said that if Mr. Potter filed his decertification request a week after the fact, workers at Green Thumb Industries wouldn’t have been able to vote out union officials in a coercive and hasty manner.

Unions lose their buzz

GTI employees aren’t the only cannabis workers to have second thoughts about joining a union. In July, Cresco Labs employees In Illinois, employees voted to decertify their union. Employees voted 97 to 34 to decertify their unit from the UFCW.

This was the second group at Cresco To dump their union. Workers at a Fall River, Massachusetts production facility voted in April to drop the UFCW.

He said: “There were many issues.” We received grievances from workers, but did not hear back from the union until we started the process of getting rid of them. There was little interaction. . . We never had a steward. “People felt they were paying (dues for) nothing.”
