The Health Committee of the German Bundesrat has just issued recommendations on the Medical Cannabis Act (MedCanG). These proposals are expected to be voted on in the Bundesrat plenary session on November 21, 2025.
Key points:
• : Medical cannabis prescriptions issued in other EU/EEA countries should not be recognized under the new law. The reason is that state authorities cannot verify compliance with the mandatory in-person consultation rule for these foreign prescriptions.
• : The German Drug Price Ordinance (AMPreisV) should apply to medical cannabis. This is intended to stop inconsistent pricing practices by pharmacies that emerged after medical cannabis was removed from the Narcotics Act (BtMG).
• : Advertising for medical cannabis outside professional circles (Laienwerbung) should be prohibited. This targets “Cannabis-Plattformen” that use mass advertising to promote quick online ordering.
• : Violating the planned ban on shipping cannabis flowers should be classified as an administrative offense (Ordnungswidrigkeit). This is aimed at ensuring effective deterrence and enforcement.
• : The Federal Ministry of Health (BMG) is urged to establish a legally sound mechanism for supervisory authorities to verify compliance with the in-person consultation rule without breaching patient confidentiality.
Whether these recommendations will be approved by the Bundesrat or through the remaining legislative process remains uncertain.
