MAPA ordinance imposes strict rules for importing Cannabis sativa seeds, including mandatory inspection.
The federal government has defined a new protocol for the entry of seed Cannabis sativa in Brazil. A Ordinance SDA/MAPA no. 1.342/2025, published in the Official Gazette of the Union of 30 July, establishes unprecedented and detailed phytosanitary rules for plant imports, focusing on strict pest control and supervision of the origin of genetic material.
Although cannabis cultivation is still a subject regulated by other legislation, the new standard deals exclusively with cannabis legal entry of seeds in Brazilthis directly affects companies, researchers and institutions authorized to work with the cultivation of the plant for medicinal, scientific or industrial purposes.
According to the Ministry of Agriculture, the goal is avoid the introduction of pests and diseases that may affect the national agricultural ecosystem, even if it is a culture that is not yet widely exploited in the country.
Mandatory requirements for import
Seeds classified as Category 4 must be accompanied by Phytosanitary Certificate, issued by the health authority of the exporting country. The document must contain three additional statements:
- Absence of pests such as Grapholita, Ditylenchus, Fusarium oxysporum and Orobanche;
- Proof by official laboratory analysis that the shipment is free of such organisms;
- Inspection at the production site during seed cultivation.
The exporting country may, in some cases, inform that a particular pest “is not present in its territory”, but it needs to communicate this justification in advance to National Organization for Plant Protection (ONPF) from Brazil to get approval.
Inspection on arrival and risk of suspension
Seeds will only be released after phytosanitary inspection at entry points. Samples can be collected and analyzed in official laboratories, with costs borne by the importer. If quarantine pests are found, the shipment will be rejected or destroyed, and the country of origin may have imports suspended until further risk analysis.
consequences for those who fail
Shipments that do not strictly meet the criteria of the ordinance they will not be internalized. In addition, compliance with phytosanitary requirements don’t exude the importer to follow other laws related to Cannabis sativa — as those that regulate the medicinal use and control of psychotropic substances in Brazil.
Understand the legal context
The measure was taken on the basis of a decision of the Superior Court of Justice in the Incident of Assumption of Competence no. 16, which defined the attributions of the Ministry of Agriculture in controlling the entry of seeds of the plant. This decision made necessary the technical regulation now implemented.
