Between Aug. 28 to Sept. 4, the New York Office of Cannabis Management, which keeps a confidential list of cannabis dispensaries who are more than 30 day late on their debts with suppliers, has grown. Just two company names According to a screenshot of the list that was shared with Green Market Report.

The new list of cash on delivery (COD) includes the two previously reported companies, Smacked LLC & Royal Leaf NY LLC as well as:

• Housing Works Cannabis LLC
• Urban Weeds LLC
• Athenian Royalty Group LLC
• New Metro Enterprise Inc.
• Luke Cloud Inc.
• Nickel City Green LLC
• Evija Artworks LLC
• Michael D Gant
• Boxing Express LLC
• Two Buds Enterprise Inc.
• The Higher Company LLC

All 13 are Conditional Retail Adult Use Dispensary (CAURD), which was reserved for “justice involved” license applicants who had some criminal marijuana record. Housing Works is at least one of the listed companies. This store was the first recreational marijuana shop in New York to open on December 29, 2022.

The COD list prohibits any company from purchasing cannabis on credit until all bills are paid and their name has been removed from the list. This is to protect the financial health of the legal cannabis supply chain.

The updated COD list has been shared with Green Market Report Dalton Battin is an attorney and consultant. His report should be “taken as a grain of sand” and not taken as proof that every retailer listed on the report is a “bad actor.”

“I don’t think that if someone appears on it, they’re necessarily bad actors.” They may be experiencing a cash flow issue that week,” Battin said. He added that the list was fluid and that retailers often appear one week, and then disappear the next after bills are settled.

Housing Works’ Retail director Sasha Nutgent stated in an email statement on Friday that its name was only listed on the COD list because of an “unfortunate mistake” with one supplier.

Our email address was incorrectly logged with one of the vendor’s AP processing companies, resulting in our AP department never receiving the invoice. Nutgent explained that the moment they saw their name on the list, they were able clear the balance.

“Our payment record to our vendors as well as our relationship with them has been positive and we look forward in the coming days to having our name removed from the list.”

An effective tactic?

Battin is skeptical about the effectiveness of the COD list, as he says there are many companies who have not paid their bills and whose names don’t appear on the list. He said that the list is used as a “bargaining chip” and has become “political”.

Battin said that the relatively low number of retailers on the list (13 out of 171 operating recreational marijuana stores) is not necessarily an indication that dispensaries were doing well financially. Many dispensaries are still struggling despite the crackdown on unlicensed cannabis sales that began this spring.

“The vendors choose who they want to report,” Battin explained. “I’m sure that last week there were more than 2 retailers who owed vendors. It’s a bit like, “If we’re good friends, I’ll not report you,” or “If we are working out something, I’ll not report you.” If I get angry with you or things turn sour, I will report you. ‘”

From what he has heard from clients, the process of adding and removing names is “seamless”.

Battin also questioned why a similar list is not available for other license holders within the supply chain.
