South Carolina Attorney General Alan Wilson has recently stated that non-alcoholic hemp-derived drinks containing 0.3% THC or less are legal in the State despite the lack of legal “guardrails”.

In a Letter Alan Wilson, state Attorney General, stated that hemp-derived non-alcoholic beverages with 0.3% or less THC are legal in South Carolina, but that lawmakers need to consider “guardrails”.
“At the moment, there are no ‘guardrails” in the law that go beyond the 0.3% statutory limit. Other states have started to look at a variety of issues, including public health, regarding THC-infused beverages.
Wilson suggests that these guardrails could include age limits for purchasing hemp-derived THC infused drinks, labeling regulations, and “whether or not there is a workable method to ensure the content of a tin meets the prescribed limits without the need to test can-by can.”
The Attorney General noted that state legislators “may well want to address which administrative agency will be responsible for enforcement and regulations” and that House members have already passed a law that includes restrictions on THC-derived hemp products.
