Tilray Brands, (NASDAQ:TLRY) (TSX :TLRY), will introduce a new line of drinks derived from hemp and containing delta-9 THC in “key markets” within the U.S. by next month.

Tilray did not specify the markets in which the products will launch, but it did mention its Happy Flower brand would get its start in Texas & Louisiana in partnership With Emergent Beverage.

Each can contains 5 milligrams delta-9 THC derived from hemp. The company claims that the drinks are designed to give consumers a “familiar, convenient and tasty way to relax and unwind.”

Tilray will leverage its existing infrastructure with Manitoba Harvest, a subsidiary that makes hemp-derived products like hemp hearts, protein, and granola. It is “Sold globally and in approximately 17 retail stores across North America.”

Despite the fact that hemp was legalized in the 2018 Farm Bill (the 2018 Farm Bill), the legal status of hemp-derived THC products remains unclear. Regulations vary widely from state to state. But several cannabis companies found ways to take advantage of the regulatory grey area.

In states like the South, where marijuana is either restricted to medical sales or banned outright, there has been a growing demand for hemp-derived beverages and other products. Minnesota, up north, has a whole regulatory framework aimed at harmonizing a market for hemp-based drinks.

Several cannabis operators have taken advantage of what seems to be a more lenient, accepted cannabis channel. HighBridge Premium, Belushi’s Farm and others have teamed up with Surly Brewing to produce their own line infused beverages. Their roll-out is similar to Tilray’s: initially targeting a few states with plans to expand up to 15 by the end the year.

If federal action is not taken, marijuana will be controlled exclusively by state regulatory regimes while hemp will be under the USDA’s control. According to economist Beau Whitney, GMR Hemp beverages have helped craft brewers in Minnesota and other states to stabilize their revenue “and save” their businesses.

The 2018 Farm Bill needs an update as the continuing resolution that was passed a year earlier expires on September 30. A final bill has not yet been agreed upon. This could mean that hemp players will have to wait another year before they can get a profit.

Other measures introduced in Congress could also change federal rules surrounding intoxicating hemp products. A number of U.S. Attorney Generals Call for Congressmen should “address glaring vagueness in the 2018 Farm Bill which has led to a proliferation of intoxicating products in hemp across the country and challenges for the ability of states and localities in responding to the resulting safety and health crisis.”
