Court: Disposing of Legal Cannabis Can Be a Criminal Offense

In a case involving a defendant fleeing from police and discarding 11.19 g of cannabis, the court found the act to constitute attempted unlawful distribution.
Although possession of this quantity has been decriminalized since 2020-04-01, the court emphasized the potential for others to find and use the cannabis. The ruling highlights how quickly legal possession can turn into punishable behavior—also relevant for cannabis clubs in cases involving the disposal of leftover cannabis.

Bavaria Halts Approved Cannabis Clubs – ā€œPure Harassment from the Topā€

2025-06-08 | The Cannabis Social Club Kirchdorf was forced to shut down just one minute after opening—despite meeting all conditions and receiving formal approval from the State Office for Health and Food Safety (LGL), according to Merkur. The closure was triggered by an order from the Bavarian Ministry for Housing, Construction and Transport, directing district offices to prohibit cannabis cultivation in already approved clubs.

Club operator Alexander Schrƶdl called it ā€œsystematic sabotageā€ and ā€œharassment from the top,ā€ criticizing the policies of State Premier Markus Sƶder. The newly forming association of Bavarian cannabis clubs also condemned the politically motivated obstruction and is considering legal action.

Although the local building authority had granted prior approval and extensive security measures were in place, the Freising district office halted operations, citing a lack of building permit. Schrƶdl had invested approximately €150,000, and the 2025 harvest is now in jeopardy. The association is now demanding either ā€œlegally sound solutions or we will exhaust all legal options.ā€

Bavaria: Another Raid on Wenzel Cerveny – Seedlings and Products Confiscated

2025-06-08 | Bavarian authorities continue their actions against Wenzel Cerveny: On 2025-06-04, 21 officers from the Erding criminal police raided another branch of his hemp business Hanf.com in Baldham, according to Merkur. The Munich II Public Prosecutor’s Office confirmed the seizure of 15 cannabis seedlings and additional hemp and CBD products. Authorities consider the distribution of seedlings—unlike cuttings—a criminal offense under the Cannabis Act.
Cerveny, who sees himself once again targeted by state arbitrariness, called it cannabis raid number 31. In late May, police had already seized nearly 1,500 plants at another location. Although previous proceedings were dropped and products returned, new charges have now been filed—this time against Cerveny’s son and brother. Cerveny himself is also under investigation for unauthorized cannabis trade.
