Volatility and Openings Across Nebraska Cannabis

We’re familiar with the often-chaotic nature involved with rolling out a new medical cannabis market, but we have never seen anything quite like what we’re seeing across Nebraska’s new cannabis program.

Below is everything we know about the current volatility across Nebraska’s cannabis industry and how you can get a coveted and valuable medical cannabis license in the Cornhusker State.

We’re writing this on September 4, 2025 so the information here is subject to change because we’ve gotten a lot of new and sometimes even conflicting information about the state of things in Nebraska.

1) Two Sets of Draft Cannabis Regulations Released

On September 2, the Nebraska Medical Cannabis Commission met and unveiled two versions of draft cannabis regulations: version A and version B. This is unlike anything we’ve seen before as the versions had substantial differences between them, including the number of retail dispensary licenses which could be issued, legality of vape products, and vertical license integration.

2) Mail-In Cultivator License Application Window Is Open Now

We also found that Nebraska’s cannabis license application window is open now. Yes, now! The window for cannabis cultivator licenses is open from September 4-23, 2025. There is meant to be a form that prospective applicants send to the MCC email (mcc.contact@nebraska.gov) or sent via US Postal Service to the MCC address: PO Box 95046, Lincoln, NE  68509.

3) Online Application Forms Coming Soon

Online, the cannabis commission states that they are “working on a form to facilitate the application process. Once that form is available it will be posted on the cannabis commission’s website so that applicants may utilize that form.” As of this writing, no form is available.

4) Other Cannabis License Types Set Later

Other license type application windows such as retail dispensary and manufacturer are set for a later date.

The first step to winning a cannabis license: start planning your business and application now! This is especially true for cannabis cultivators. While previous Nebraska regulation drafts had stated that there would be an unlimited number of cultivation and manufacturing licenses, this has been dramatically reduced to just four each. There will also only be 12 dispensary licenses statewide.

Applicants will be required to submit substantial information about the readiness of the cannabis business to launch operations, business planning, team (staff) experience, facility specifications, and financial modeling.

A score of 70/100 is necessary to be considered for licensure.
