Former Met Pcs Jonathan Clapham, and Sam Franks have won an appeal over a ruling that said they lied when they claimed they could smell marijuana.

After winning an appeal, two former Metropolitan Police officers will be given their jobs back and receive back pay after a ruling that found they lied when they claimed to have smelled cannabis during a stop-and-search of British athlete Bianca Williams (and her partner)

Former Met Police Pcs Jonathan Clapham, and Sam Franks have been dismissed by a disciplinary committee in October of last year. The panel found that they lied when they stopped Olympic sprinter Ricardo Dos Santos on July 4, 2020.

The police followed the athletes on their way home from training in west London, with their three-month-old son in the backseat of their Mercedes.

The Police Appeals Tribunal overturned the disciplinary panel’s decision on Friday. It found that the original decision had been “irrational” as well as “inconsistent”.

Damien Moore, chairman of the Appeals Tribunal, said that former Pcs Clapham, and Franks, were “dedicated and hard-working officers” whose careers had been “ruined” because of the original findings.

After the hearing, Mr Dos-Santos announced that he would now challenge the “disappointing decision” in civil courts.
