The government is in danger abandoning the long-anticipated “Pillar 2” due to the ongoing political roadblocks, both from within Germany and the EU.

The race is on to pass legislation that will move the second half of the cannabis liberalisation project forward.

A growing number of municipalities have expressed their interest in participating in model projects that will be introduced by Pillar 2

What is Pillar 2?

The traffic light coalition responded to the European Commission’s pushback regarding its initial plans to launch an adult-use market by announcing pillar 2, first announced in summer 2023.

According to reports, the EC informed the German government of the plans’ potential violation of numerous EU laws such as the Shengen Agreement. This could have put the country at risk of infringement proceedings.

The bill’s architects then proposed two separate “pillars” that would still aim to reach its key goals while not violating EU law.

The second would allow the launch of “pilot projects” where the open sale of cannabis for adult use would be allowed for limited duration to study scientifically the impacts on different areas, such as the black market, youth protection, and health.

Seven pilot projects are currently being implemented in Switzerland.

What is the current situation?

The bill draft was originally scheduled to be ready at the end of the summer of 2023. However, this was delayed to April 2024.

It was originally planned that a secondary law would be needed to launch Pillar 2. Cannabis Business Reporting in MayIt is expected that it will be regulated by the current CanG law. This means that a separate law won’t be needed to push it through.

According to Chapter 1 Section 2 paragraph 4 of the current CanG Act ‘anyone wishing to possess, cultivate or produce cannabis, import, export it, acquire, receive, give, or pass it on for scientific purposes; extract cannabinoids, or trade in cannabis, for scientific purposes’, requires a permit.

In the draft bill of April, titled ‘Consumer Cannabis Science Responsibility Ordance’ (KCanWV), BLE, the Federal Ministry of Agriculture and Food, assigned itself as responsible authority for granting permits, monitoring and implementing regulation.
