Two men falsely charged with drug possession and trafficking have sued Portage County Sheriff Bruce D. Zuchowski, and three of his deputy sheriffs in federal court. They are asking for a juror to determine unspecified damage.
A traffic stop was conducted by Portage County Sheriff’s Deputies on August 29, 2023. Zephaniah and Jack Metcalf were charged with cocaine trafficking and possession, both of which are first-degree felonies.
The county prosecutor’s case was abandoned when it turned out that the alleged cocaine found in the back seat of the 2018 Buick Enchante was actually baking soda, which Robinson’s sister who owned the vehicle had sprinkled into the back to combat an earlier water problem.
The two men, who were both Black, were arrested in the Portage County Jail. Robinson was released two weeks later on a personal recognizance (PR) bond of $75,000 with conditions, but Metcalf was still incarcerated and remained so until Oct. 11 when he posted the same PR bond.
The case was not dropped by the prosecutors until mid-November. Robinson and Metcalf were also subjected to almost three months of court proceedings, electronic monitoring devices, and, according the federal lawsuit, losing their jobs.
Robinson and Metcalf have now filed a lawsuit against Zuchowski, Sean Bradley, Robert Paolucci, and Anthony Zappone at the U.S. District Court.
In a lawsuit filed on August 29 in the U.S. District Court for the Northern District of Ohio’s Eastern Division, their attorney, Eddie Sipplen of Akron stated that there was no justification to frame and create false evidence against the Plaintiffs.
The two are seeking punitive and compensatory damages, declaratory relief and injunctive, attorney fees and costs, and other relief. The amounts will be decided by a juror.
They allege, in particular, that their right against unreasonable searches and seizures by force was violated. They also claim that they were falsely arrested, that they were maliciously prosecuted, and that their due process rights have been abused. The government is also held liable for their actions, and that deputies engaged “willfully, wantonly and reckless conduct.”
The Portage County Sheriff’s Office has not returned. The Portager’s Request for comments
No court date has yet been set.
How false accusations are made
Zappone initiated the incident during a routine traffic check on I-76 Westbound near Tallmadge Road. The lawsuit claims that the car Robinson was driving had no sideviews mirrors and a license plate displayed incorrectly.
The lawsuit claims that Bradley radioed Zappone to tell him he thought the person in the car was a man wanted on suspicion of second-degree burglary.
Zappone, armed with this information, decided to treat a routine traffic stop as an felony stop. He allegedly ordered Robinson & Metcalf from the vehicle under threat of a gun. After Bradley and his K-9 unit arrived, the officers realized that neither Robinson or Metcalf was the suspect.
