California has banned hemp-derived THC products as of this week, following the approval of the emergency regulations proposed earlier this month by the Governor.
The full story is below the jump.
The crackdown on hemp products proposed by California Gov. Gavin Newsom’s (D) emergency rules took effect this week, after officials approved them. Early this month.
The new rules that took effect on Monday, September 23 require that all hemp-derived cannabinoid product sold in the state contain “no detectable total THC”. They can only be sold by individuals 21 years of age or older. The rules also limit the amount of product to five servings.
The ban has impacted the hemp retail industry, which includes infused beverages, capsules and gummies as well as topicals.
Charlotte’s Web, a manufacturer of CBD products, said in a statement that the company has been able to secure a contract with a major pharmaceutical company. Press release The ban on hemp-derived THC, which targets many products that are not intoxicating and have health benefits, is an overreach.
“While we fully endorse efforts to regulate synthetic products and intoxicating products we strongly oppose their inclusion within this regulatory framework. We believe that these regulations are excessive and restrict access to non-intoxicating hemp goods by lumping them with a different class of products. Other states, such as Colorado and Virginia, have set shining examples on how to clean up the marketplace while safeguarding products consumers depend on for their health and wellbeing.” — Bill Morachnick CEO of Charlotte’s web, in a press release
The governor’s office stated that the ban would prevent children from being exposed to intoxicating substances in the state. Newsom, who proposed the rules, said that he would not “sit on our hands” as drug dealers target children with unregulated hemp products that contain THC in our retail stores.
