The political campaign to expand Arkansas’ medical marijuana program. A lawsuit was filed against officials This week, after its initiative was Ineligible For the November election, they claimed that the secretary used a subjective interpretation to disqualify the measure.

Arkansans for Patient Access (the campaign behind the measure) argued in their lawsuit that Secretary State John Thurston used a strict definition of state legal requirements, that the “sponsor’ of a ballot measure must be accountable for all official filings as opposed to workers or volunteer with the campaign.

The suit argues that this is “nonsensical”, according to the Arkansas NPR affiliate. The campaign is asking the state Supreme Court to reverse Thurston’s findings.

Arkansans for Patient Access submitted over 150,000 signatures of voters, well beyond the 90,000 required to qualify for the November ballot. However, Thurston’s Office found that the campaign still fell short, with only 88,000 valid signatures.

KUAR reported that the suit also alleges that Thurston and Attorney-General Tim Griffin violated laws relating to ballot measure certification, by delegating tasks related to signature validation instead of performing these tasks directly themselves.

The campaign has asked a state court to “expedite review” its lawsuit, given the upcoming election next month.

KUAR reported that even though the ballot question has not been presented to voters yet, it will appear on the actual ballots because they have already printed. The lawsuit will determine whether the votes cast on the ballot question will be counted or if the law will be implemented if the plaintiff wins.

The measure would expand Arkansas’ medical cannabis industry by increasing Arkansas’ number of medical professionals who are allowed to write patient recommendation, legalizing home cultivation for medical marijuana patients, and increasing the number medical ailments that patients are eligible to purchase cannabis.
