Hemp beverage news from South Carolina (opinions in comments)

The South Carolina solicitor general has issued an opinion today to the Speaker of South Carolina House of Representatives regarding the legality of distribution and sale of non-alcoholic drinks containing delta-9 THC derived from hemp below 0.3%.

The opinion reviews case law and federal and state law to determine if the products are legal if certain elements have been met.

The opinion states that the legislature may wish to revisit the “Hemp Farming Act of 2019,” in order “to deal with the various issues surrounding regulation of hemp-infused beverages and food products”.
