NORFOLK (Va.) – Matthew Taylor Morris pleaded guilty for his role in a conspiracy involving the distribution of large amounts of marijuana.

According to court documents Donald Thomas Rogers of Portsmouth, 35, owner of a Federal Firearm Licensee, allegedly became involved with the interstate trafficking in bulk quantities of marijuana beginning at least in January 2021. The Rogers Drug Trafficking Organization, working with Nicholas Cameron Capehart (30), of Norfolk, Jeffrey Donald Sines (39), of Portsmouth, stored approximately 1,000 pounds marijuana and cash proceeds in Morris’s Top Tier Law located on South Independence Boulevard, Virginia Beach. The street value of the Tetrahydrocannabinol products (THC) stored at Morris’s office ranged between $800,000.00 and $1.6,000,000.00.

Rogers was the owner and operator of VA Premier Pawn – a FFL that is authorized to sell firearms. Rogers is alleged to have purchased wholesale quantities from outside Virginia of THC products such as marijuana, THC vape pen, THC wax and THC edibles. Rogers allegedly sold the products in smaller amounts to his coconspirators Capehart, Sines and Morris for retail sale.

Morris introduced Capehart, believing initially that Capehart could provide Rogers with THC-containing products. Rogers, who allegedly sold more marijuana products than Capehart did, began supplying THC products to Capehart and others, including Morris. Morris, who first met Rogers 2021, referred his clients, including his legal ones, to Rogers, for the illegal purchase THC products. Morris eventually offered Rogers a room within his law office for Rogers’ THC product storage.

Rogers, in exchange for the use of the office, allegedly paid the monthly rent to the office for several months. Morris also allegedly gave Rogers the key to the office to facilitate his access. Rogers also allegedly agreed to provide Morris with 15 pounds per month of THC products for a total weight of approximately 70 pounds, so that Morris could sell marijuana to retail customers. Rogers allegedly gave Morris a 9mm pistol, despite Morris’s use of Adderall cocaine, opiates and THC.

Capehart, while on vacation in Las Vegas on April 20, 2021 sought Morris’ advice about sending marijuana products to the Tidewater area because Capehart was aware that Morris was an lawyer. Morris instructed Capehart in text messages to mix marijuana products with “some souvenirs” and to buy Saran Wrap to wrap the package. Morris also told Capehart that she should address the package to Morris’ law firm.[w]It would be difficult for the police to obtain a warrant if they didn’t have legal mail.

On October 17, 2022, the law enforcement officers allegedly saw Capehart in a parking lot at the FFL, retrieve a large, black bag from Rogers’ car and place it on the backseat of Capehart’s pickup truck before leaving. Capehart drove to his home and brought the bag in. The Suffolk storage unit was identified by law enforcement as belonging to Sines, Capehart and their vehicles. On October 27, 2022 law enforcement observed in the storage unit several duffel bags that were similar to the ones Rogers and Capehart had allegedly owned on October 17, 2022. Each bag contained between seven and eighteen pounds of marijuana. They also found boxes with marijuana, THC vape pen, THC wax and THC edible products. The storage unit contained a total of 193 pounds marijuana, 1,410 vape pens with THC, 136 jars with THC wax and 228 bottles THC syrup.

Rogers, Sines and another individual entered the storage unit on Nov. 3, 2022. Sines left with a duffel and the other individual with a cardboard box. Sines took the duffel bag back to his residence which was located next to Rogers.

On Nov. 9, 20,22, law enforcement executed an search warrant at the storage unit. They recovered 141 pounds of marijuana as well as 400 THC Vape Cartridges, 16684 grams THC Wax and 196 bottles of THC Cough Syrup. On Nov. 10, 20,22, agents executed 10 additional search warrants at the suspected locations, vehicles and members of Rogers DTO.

Agents recovered four firearms at Rogers’ residence, along with a silencer, $23,980 and 1,899 grams marijuana products. They also found three cellphones. Agents recovered 145 firearms at the FFL along with $181,000 and $80,879 worth of gold and silver.

Agents recovered 10 firearms at Sines’ residence along with 36,676 grams marijuana, 529 gram mushrooms, thousands rounds of ammunition and $7,686.

Agents recovered at Capehart’s residence 13,042 grams marijuana, $14 036, 16 firearms and three black bags that matched the bags found in the storage unit.

Morris and Sines pled to guilty today of conspiracy to possess marijuana with the intent to distribute it and possession with the intent to distribute it. Morris will be sentenced to prison on Jan. 22, 2020, and could face up to ten-years. Sines faces up to a 20-year prison sentence for each count when he is sentenced on February 7, 2025. Rogers will plead guilty to the charges on September 30th, and Capehart will plead guilty to the charges on October 3rd. Typically, federal crimes carry lesser penalties than their maximum. The U.S. Sentencing Guidelines and other statutory factors will be considered by a federal district court judge when determining any sentence. The Sentencing Guidelines, as well as other statutory factors will be considered by a federal district court judge.

After U.S. District Court Judge Jamar K. Walked accepted the plea, Jessica D. Aber, U.S. attorney for the Eastern District of Virginia, James VanVliet, acting special agent in charge of the Bureau of Alcohol, Tobacco, Firearms and Explosives Washington Field Division, and Ramin Fatehi, Norfolk Commonwealth Attorney, announced the news.
