California Gov. Gavin Newsom signed Assembly Bill 1775 on Monday, giving local jurisdictions permission to allow “cannabis cafés” to serve non cannabis-infused food and beverages to patrons who consume cannabis on-site. Newsom vetoed the same bill in 2023, citing health and safety concerns for cafe workers as well as the importance of maintaining smoke-free workplaces.
Newsom wrote that he commended the author (Assemblyman Matt Haney D-San Francisco), for including additional safeguards. These included explicitly protecting employees’ discretion in wearing a respirator mask, which was paid for by the employer, as well as requiring employees to be given additional information on the risks associated with secondhand cannabis smoke.
Newsom warned that future legislation which goes against the “tailored” approach would “not be viewed favorably.” He also urged local governments to use their delegated authority responsibly, prioritizing worker’s safety and implementing strict safeguards that minimize risks to public health when authorizing such activities.
The governor warned that failure of these safeguards could lead to “reconsideration” of this limited expansion.
