Former senior officials at California’s Department of Cannabis Control are The agency can be suedShe claims she was wrongfully terminated after raising concerns over widespread fraud in state licensed cannabis testing laboratories.
Tanisha Bogans claims that in a lawsuit filed last week, the DCC failed at addressing rampant THC potency and deliberate failures of labs to detect harmful contaminants such as pesticides and mould.
Bogans, a former employee of the state who was terminated on January 20, 2024, claims that her dismissal was due to repeated warnings regarding unethical practices within the cannabis testing system. Bogans, according to the lawsuit reported these concerns to DCC official, including director Nicole Elliott as early as June 20,23. Her lawsuit highlights that, despite her efforts to stop the fraud, the agency refused to take action. She claims this has damaged the legal cannabis industry in California.
The suit was first reported by Bloomberg Law, accuses DCC of illegal retaliation as well as violating whistleblower rights. It also seeks compensation from unpaid business expenses. Bogans’ claims echo long-standing industry allegations that certain labs manipulate test result to inflate THC or pass cannabis products which should fail due to safety reasons.
The DCC has reportedly increased enforcement efforts in recent months against labs accused fraudulent activity. However, these actions took place after Bogans was fired. The DCC declined comment on the lawsuit and personnel matters.
