Now that Ohio voters chose to legalize recreational marijuana, Gov. Mike DeWine is focusing his efforts on a new target, delta-8 or, as he refers to it, “intoxicating weed.”

Now that Ohio voters chose to legalize recreational marijuana, Gov. Mike DeWine is focusing his efforts on a new target, delta-8 or, as he refers to it, “intoxicating weed.”

There is no law that prevents kids from purchasing it. Delta-8 THC is not sold in marijuana dispensaries, but rather in smoke shops and gasoline stations.

DeWine spoke about delta-8 at a Columbus news conference on Wednesday and urged lawmakers in Ohio to ban or regulate this substance. He also revealed that he and his team conducted an “undercover sting” operation with teenagers in order to prove that minors had access to the drug.

Delta 8 is a derivative from hemp but it will still cause users to fail a drug screen.

DeWine has urged state lawmakers to ban Delta-8 because, he claims, it is under-regulated and that it can be purchased by children.

Andy Wilson, Director of Public Safety at the Department of Public Safety, said “These look like cereal” as he and Governor held up THC products.

The Governor is again urging lawmakers to act.

DeWine stated that the biggest concern is that kids who walk in and buy it legally.

The 2018 Farm Bill of Congress allowed hemp products to be sold at any retailer, as long as the products contain.3% or less THC.

Wilson said that these products were definitely marketed and designed for children. “Furthermore this is an unregulated form delta-8 THC.”

Wilson said that his team sent two 15-year olds to a gas station undercover. Wilson’s nephew, and his friend, went on the mission. Both were wearing basketball uniforms following a school match.

He played an audio clip of teens buying delta-8 products with ease.

“Would you like this cookie or that one?” The clerk asked the teens.

“We’ll get, we’ll just do this one,” a 15-year old replied before purchasing a gummy candy infused with delta-8.

DeWine said that the teens were able get the products legally and easily, which is unsafe and unacceptable.

DeWine said that “scientific data clearly indicates” that children should not consume this product because it affects the brain.

Ohio does not have an age limit for buying delta-8.

“That’s not our problem.” DeWine said, “We need to change this.”

Joel Fink, a hemp processor and retailer, agrees with the need for age restrictions but is concerned about overreach.

“What’s needed is either self-regulation, by making sure you have to be at least 21 to buy these things, or, if there was a ruling from the legislature, I wouldn’t be too keen on getting the legislature involved, as you can tell,” he said.

Fink said DeWine might be exaggerating the lack of regulation, since the Department of Agriculture oversees the process.

“Yes, products similar to what we produce are available in convenience stores and gasoline stations.” “But it’s fully regulated and has been thoroughly tested,” he said.

The governor wants to tackle intoxicating hemp.

DeWine said, “I’m asking the legislature to act so that we…get these products…off the shelves.”

Statehouse reporter Morgan Trau questioned DeWine about the fairness of banning all delta-8, because they visited a gas station that sold to minors.

He replied, “There is no law or standard.” “We don’t depend on the goodwill on every clerk for any other product.”

DeWine said that he was fine with a ban, whether it be total or partial — allowing delta-8 to be sold in dispensaries.

Steve Huffman, a state senator, is the leader of a new bill that has been in development for more than a week. He is trying to balance the safety concerns with business and consumer concerns.
