John Kuehn filed the lawsuit earlier this month. He is a former State Board of Health member, veterinarian, and rancher, who has been opposed to any form of legalization of cannabis.

Strong stated that precedent would allow for some clerical or technical errors to be ignored if the information could be inferred by other evidence in a petition, such as when it was signed. However, it was important to determine if the alleged mistakes fell into this category. The order allowed both counts of signature disputes to go to arguments.

In a press release, Crista Eggers of Nebraskans for Medical Marijuana said that the group was “grateful for Strong’s decision to dismiss the single-subject and sponsor sufficiency allegations against our ballot initiatives” today and that it “will continue exercising all legal options” to challenge the signatures.
