A meeting of the parliamentary committee held in Philipsburg on April 9 gave new political impetus to the project legalization of cannabis and the regulatory framework envisaged Sint-Maarten, as lawmakers continued to question the economic, health and governance implications of a future legal market.

The session, chaired by the parliamentary committee on agriculture, fisheries and livestock, followed a previous meeting held on March 13. At the heart of the discussions was a detailed plan presented by Native Nations SXM, the organization chosen by the government to help design the island’s future cannabis system.

The debate revealed both growing interest in the economic potential of the project and ongoing concerns about how the sector would be structured, who would benefit from it and how risks would be managed.

A government-led roadmap

The proposed framework finds its origin in the sint-maarten Government Program 2020-2024, who identified the cannabis regulation for medical, scientific, recreational and religious purposes as a national priority. This initiative is also included in the island’s economic recovery plan, where cannabis is listed among the six targeted tourism export sectors.

Following a tender launched in September 2022, Native Nations SXM was given the mandate to develop a comprehensive roadmap for legalization, including research, legislative drafting, regulatory structures and implementation timetables.

A key part of the deal is that the government would not pay the initial costs. In return, Native Nations would benefit from one 10 year concession enabling it to operate strategic industry segments such as cultivation, processing, testing and distribution, while committing to pay $750,000 per year to a foundation supporting social, economic and environmental initiatives.

The proposed framework also provides for the creation of a Cannabis Supervisory Authority, compliance with the requirements fight against money laundering (AML) and of fight against the financing of terrorism (CFT), as well as a complete traceability system from seed to sale. Officials said the measures were developed in consultation with the Central Bank of Curaçao and Saint Martin.

Tourism considered a key economic driver

Much of the expected market growth is linked to the island’s heavy tourist traffic rather than just local demand. Saint-Martin, which has around 100,000 inhabitants spread across both sides of the island, welcomes more than two million visitors each year.

According to Native Nations, the proposed model estimates that approx 28% of tourists could use cannabis, based on comparative data from destinations such as Nevada and the Netherlands.
