Boston.com reported that if the initiative passes, Massachusetts will become the third state in the country to make such a policy change, after Oregon and Colorado. Both states had ballot measures for legalizing psychedelics that passed.

The ballot measure is limited in that it doesn’t create a new industry. However, it allows for home cultivation and the purchase and consumption of psychedelics at licensed facilities under the supervision of trained health professionals. The structure is similar in Colorado, where voters approved a similar measure. Approved in 2022. Oregon legalized psilocybin In 2020, no other psychedelics will be available.

If Question 4 passes, psilocybin and psilocin will be legalized in Massachusetts. Dimethyltryptamine (DMT), ibogaine, mescaline, and ibogaine would also become legal in December. It also includes a requirement for the home cultivation of “magic mushrooms” in a 12-foot-by-12-foot space, and the sharing of Psilocybin between adults.

Boston.com reported that the launch of therapeutic centres where patients can partake in sessions for treatment wouldn’t start until 2026, at the latest. A phased-in implementation is written into the law. The regulations for all five psychedelics are unlikely to be completed until 2028.

The initiative would create a governing agency that would oversee the psychedelics industry, a five member Natural Psychedelic Substances Commission, and a 20 member Natural Psychedelic Substances Advisory Board. These boards would make policy recommendations on topics such as taxation.

Psychedelics sold at treatment centers will be subject to state sales tax, a 15% excise and a local tax of up to 2% that can be added by municipalities. Cities and counties could not ban psychedelic centers, but they can add their own rules.

Massachusetts for Mental Health Options is promoting Question 4, which asserts that psychedelic treatment can be “a really useful option” for those suffering from post-traumatic disorder, anxiety, depressive disorders and other mental health issues.

Bay Staters for Natural Medicine is another group that supports psychedelics. They came out against the ballot initiative, arguing the high cost of proposed treatment centers would lead to an underground market for psychedelics.

James Davis, founder of the coalition told Boston.com that “it’s not legal” if no-one can afford it.

Davis said that while he agreed that if people were growing and sharing cannabis, it would put downward pressure on prices, if the regulatory framework to operate legally was so expensive, it was almost predatory towards those who wanted to set up a legal facilitator center. “Because, you’re basically saying that an illicit market will undercut your hard work if it’s legal.”

A second opposition group, Coalition for Safe Communities, also emerged to oppose Question 4 because of its home cultivation provision. It claims that the size of any private home to grow mushrooms is “astronomical”.

Chris Keohan, spokesman for the coalition, told Boston.com that the group does not dispute the potential benefits of psychedelic treatment.
