The Allen Police Department raided nine hemp retailers in Texas this week after discovering that they were selling products with illegal amounts of THC. Dallas Morning News reports.
Allen police said that the Drug Enforcement Administration and Collin County Sheriff’s Office were involved in the investigation.
The warrants were obtained after an extensive investigation into alleged illegal activity involving the sale products that contained more than 0.3% THC (the psychoactive component of marijuana). The products previously sold at nine locations tested between 7% and 78% THC.” – Law enforcement written statement via Dallas Morning News
The report stated that after the DEA subpoenaed company records in July, companies selling legal hemp products hired San Marcos attorney David Sergi to prepare for an incident such as this week’s raid. Sergi represents at least nine of the nine shops that were targeted in the raid. He says his clients are operating legally under the law and that the raid was an “escalation”.
He said, “There are right and wrong ways to deal with products out of compliance under Texas law, and these people have taken the wrong path and will be held accountable.”
Cannabis remains illegal in Texas Although hemp, the nonpsychoactive version, was made Federally legal Under the 2018 Farm Bill. Since then, hemp industry cannabinoid products have expanded, from CBD, which is not psychoactive, to include intoxicating endocannabinoids such as delta-8 and delta-10, which can be synthesized both from hemp-derived CBD. These products are claimed to be legal under the current Farm Bill definition of hemp. However, the DEA has stated otherwise.
