News 5 takes a deep dive on Issue 2 and the implications for Ohioans. This is a great chance to learn more about Issue 2 and its potential impact.

What is Issue 2?

According to the ballot text, Issue 2 enacts new chapter of the Ohio Revised Code that allows controlled and regulated cannabis sales and use for adults over 21. It also establishes Division of Cannabis Control in the Ohio Department of Commerce.

The Division has the authority to regulate, investigate, and penalize adult use cannabis operators, testing labs, and individuals who are required to be licensed.

The law regulates the sale, purchase, possession and use of cannabis for adults over 21 years.

Ohio law allows adults 21 years and older to possess up to 15 grams or 2.5 ounces cannabis. Individuals can cultivate up six cannabis plants in their primary residence, or up to twelve at a residence with two or more adults.

The sale of cannabis in dispensaries is subject to a 10% tax, on top of the usual sales taxes. The 10% tax is distributed as follows: 36% will go to a cannabis social equality and jobs fund; 36% will go to a host-community cannabis facilities fund; 25% to a drug abuse and addiction fund; and 3% goes to the division of cannabis control commission and tax commission.

The law allows employers and landlords to prohibit cannabis use in certain circumstances. It also prohibits driving a vehicle while under the influence or using cannabis. The use of cannabis in a combustible form is also prohibited when a passenger.
