Maine Law Allowing for Sealing Certain Cannabis Crimes now in Effect – Gajapreneur (19459000)

Maine residents can now apply to seal their criminal records for certain cannabis crimes under a new law that went into effect this month. The law applies to crimes which are now legal after the state’s adult use cannabis reforms.

This month, a Maine law that allows individuals to seal their criminal records for certain cannabis crimes took effect. Maine Morning Star reports. The law applies to crimes which are now legal under the adult-use cannabis laws of the state.
In an interview with The Morning Star, criminal defense attorney Matthew Morgan, partner at McKee Morgan noted that under the law some professional licensing agencies are not allowed to refuse licenses. Law enforcement The records will still be accessible, but they will be sealed. People can then indicate that they don’t have a criminal history based on this sealing.
Barbara Cardone, Director of Legal Affairs and Public Relations for the Maine Judicial Branch said that the courts were unable to provide any data on how many people had requested their criminal records be sealed under the new rule.
Last session, lawmakers considered a bill that would automatically seal cannabis-related criminal records that are now legal. However, the proposal was rejected due to concerns about the cost of the program (about $633,000 per judicial branch analyst) and First Amendment concerns raised by the Maine Press Association. The Maine Press Association argued that sealing records automatically would violate the First Amendment right of the public access to records of criminal proceedings.
