A legislative committee in Chemung County will vote on a law that will shut down cannabis shops without a license. If the “Multi-Services Committee”, the county’s legislative committee, approves the law on Monday night it will be put to a vote by the County Legislature.
The “Chemung Unlicensed Cannabis Regulating Law” states that it “applies to anyone’ selling cannabis, cannabis-related products, or any product marketed as such, in a “place of business,” without obtaining the proper registration, license, or permit, or engaging in “indirect retail sales” in a “place of business.”
Chris Moss, Chemung County Executive, said, “The Governor, in her budget, approved local governments to enforce illegal marijuana sale.” “They’ve been called sticker stores in the area. They’ve been a nuisance in upstate New York and, I believe, throughout the state. This will give us the authority to lock down businesses, fine businesses, hold hearings, etc.,” Moss said.
“The county attorney has drafted a local statute.” I believe the legislative attorney has also reviewed it. “We hope it passes through the multi-services tonight, and goes to full legislature.”
The Chemung County Sheriff’s Office is the agency that will be responsible for closing down illegal cannabis stores. The Sheriff’s Office will have the authority, along with the Chemung County Code Officer and the Public Health Director of the County to:
“Issue an order to seal a building or premises that is engaged in unlicensed activities, issue a notice of violation, seize cannabis, cannabis products, or any product labeled or marketed as such, and seek injunction against any person who violates this section.”
