The proposed regulatory changes include a highly anticipated change that will allow delivery licensees to deliver marijuana and marijuana products with only one Marijuana Establishment registered agent in a vehicle, instead of the current requirement of having two agents, when delivering items up to a total retail value of $5,000. Two agents would still be needed to staff vehicles transporting items with a retail price exceeding $5,000, up to and including the $10,000 maximum. According to the change, Social Equity Program Participants and Certified Economic Empowerment priority Applicant Businesses with exclusive access to the delivery licenses types would also be permitted to hold 3 Delivery Operator and 3 Delivery Courier Licenses for the very first time.

The draft changes include a proposal that Microbusinesses can apply for other types of licenses, such as Retail and Transport Licenses; Qualifying Medical patients may opt-in to use telehealth consultations with a Certifying Healthcare Provider to receive their initial certification. Nurse Practitioners who have independent practices will also be able to certify Qualifying Patient without a supervising physician.

Any feedback on the draft regulations must be submitted to Commission during the specified period for public comments, but no later than October 7, 2020. All submissions must include the submitter’s full name and affiliation or organization, if applicable. The Commission will review all submissions received before the deadline and may include them in the final version of the regulations that will be discussed at a public meeting. Please be aware that the Commission can publish or produce any submissions received in response to a Massachusetts Public Records Law (M.G.L.) request. c. 66 or SS 10 or any other legal process that is mandatory.
